In the order of pre-trial settlement of the dispute between the client and the person obligated under the investment agreements, the mediation procedure was carried out. The complexity of the negotiations was due to the minimal chances of obtaining a decision of the arbitration court in favor of the client.
The investment contracts assumed a return of investment and profit 5 years after their conclusion. The profit received did not meet the client's expectations and a decision was made to withdraw from the concluded investment contracts. In the event of a unilateral withdrawal, the investment amount was not returned.
We decided to conduct comprehensive negotiations in which we managed to convince the party obligated under the investment agreement not only to return the investment amount in full to the client in the shortest possible time, but also to pay 20% of the total investment amount as interest for the use of funds.
The dispute was resolved by signing additional agreements to the investment contracts, which change the procedure for the return of investments in the most favorable way for the client.
